New Federal OSHA "workaround" guidance released
COVID-19 Vaccination and Testing ETS is now available for review
Biden's Federal OSHA Vaccine "workaround" as they themselves call it, for companies over 100 has been released, and they will require weekly testing, identification of status, and forever-masks as punishment for those who don't get vaccinated.
“Companies also have until Dec. 5 to offer paid time for employees to get vaccinated and paid sick leave for them to recover from any side effects,” the report added.
The Occupational Safety and Health Administration will also be policing workplaces nationwide to ensure compliance with the unlawful mandate.
“OSHA, which polices workplace safety for the Labor Department, will provide sample implementation plans and fact sheets among other materials to help companies adopt the new rules,” according to CNBC.
“OSHA will also conduct on-site workplace inspections to secure companies compliance, a senior administration official said. Penalties for noncompliance can range from $13,653 per serious violation to $136,532 if a company willfully violates the rules,” the report added.
“Determination of employee vaccination status. The ETS requires employers to determine the vaccination status of each employee, obtain acceptable proof of vaccination, maintain records of each employee’s vaccination status, and maintain a roster of each employee’s vaccination status.”
Also, this is not to be confused with the tyrannical Executive Orders for Federal employees/ contractors, which are much stricter.
Federally, any company with over 100 employees will have to comply, and should they fail, the Build-Back-Better Bill incorporates a plan for even steeper fines, should it get passed.
Biden's 900% increase in OSHA fines is included in Pelosi's latest version of the Biden Budget Buster.
The really good news: People who work from home are exempt.
A US Dept. of Labor official has apparently also made a comment that they might go after small businesses next, but just how they would implement such a mandate on the grassroots level, where there is the least compliance, is unclear.
The Times wrote in September that US Labor department officials were frustrated with the White House for using OSHA for testing and Vaccine mandates.
Also, it’s important to note that the White House through OSHA, is using the EST (emergency temporary standard). The spring ETS rule took nearly six months to issue. According to OSHA, an ETS takes up to six months to go into effect after the initial mandate is issued in the Federal Register.
“OSHA has used that legal authority only 10 times in 50 years,” David Rivkin Jr. and Robert Alt wrote in the Wall Street Journal in September. “Courts have decided challenges to six of those standards, nixing five and upholding only one.”
It will be interesting to see what happens this time around.
